Cottage Licenses

 

A Cottage License is an agreement between myself (the designer) and you (the knitter) that legally allows you to hand knit/crochet and sell garments made from my patterns. Each pattern is sold separately from licenses and must be purchased before you can obtain a license. You are only able to sell items made by following a legally purchased pattern and license. Each license granted is for a single individual, not for knitting groups or more than one person.

 

Annual Limited License for a Single Pattern

Cost: $20.00 USD.
Duration: 1 year from date of purchase.
Features: This license permits you to knit and sell a maximum of 20 garments from the specified pattern for the duration of 1 year from the purchase date.
Annual Unlimited License for a Single Pattern

Cost: $40.00 USD.
Duration: 1 year from date of purchase.
Features: This license permits you to knit and sell an unlimited number of garments from the specified pattern for the duration of 1 year from the purchase date.
Annual Unlimited License for Full Access

Cost: $150 USD.
Duration: 1 year from date of purchase.
Features: This license permits you to knit and sell an unlimited number of garments from my entire line of patterns for the duration of 1 year from the purchase date. This included any new patterns added to my pattern line during the specified access time.

Lifetime Unlimited License for a Single Pattern

Cost: $60 USD.
Duration: For the lifetime of the purchaser (really a good deal for people who intend to be turned into a robot to avoid death).
Features: This license permits you to knit and sell an unlimited number of garments from the specified pattern forever.

 

Lifetime Unlimited License for Full Access

Cost: $750 USD.

Duration: For the lifetime of the purchaser.

Features: This license permits you to knit and sell an unlimited number of garments from my entire line of patterns forever. This includes any new patterns added to my pattern line.

 

Annual Unlimited License for Images of a Single Pattern

Cost: $30 USD.

Duration: 1 year from the date of purchase.

Features: This license permits you to use any of my photographs of the specified pattern for the duration of 1 year from the purchase date.

Terms and Conditions

 

  1. Please read the following Terms and Conditions below to ensure that you are able to abide by them.
  2. Please ensure you have purchased a valid version of the patterns that you wish to knit and sell garments from (if applicable).
  3. To apply for a license, please email me with your full name, home or business address, email address, phone number, where you intend to sell the patterns at (a link to your Etsy store, website, or venue like farmer’s market, etc.), and the names of the patterns you are interested in buying a license for.
  4. Once you have applied for a license, you will be sent payment details for Paypal. You must receive payment confirmation from me before you begin selling items under the license.
  5. You will be emailed a confirmation and agreement, which outlines the details of the Cottage License, including period of the license and the patterns you are licensed to knit and sell from. You must email me back that you agree to the terms specified in the agreement before you begin selling items.
  6. The license will only be granted upon receipt of payment and the email agreeing to the terms.
  7. 7. Photo licenses only applies to images of the specified pattern that are available on my Ravelry database (sheilatoy) or website (http://www.sheilatoystromberg.com). You can use the images in your marketing, website, emails, etc., but cannot sell the image to others (either digitally or in print). Credit must be explicitly given to myself whenever any of my images are used with the following statement; “Photos by Sheila Toy Stromberg” or “Photo credit: Sheila Toy Stromberg”.
  8. I remain the sole copyright owner of all images, patterns, future patterns and modifications of the pattern lines. All patterns and images remain the intellectual property of myself, Sheila Toy Stromberg.
  9. I grant a Cottage License to sell garments hand-knit from the pattern/s under the following restrictions and requirements:
  10. This Cottage License is granted upon payment of an annual fee or one time fee. Different rates apply for different access to the patterns.
  11. This License is granted on the understanding that all garments are hand knit or crocheted by the licensee only. The use of a knitting machine to knit garments is not permitted under the terms of this cottage license. If you would like a Commercial License, contact me for the rates and terms of that license.
  12. I reserve the right to revoke licenses for any breach of this agreement or if the licensee is deemed to be engaging in unethical, hateful, discriminatory, or illegal business practises.
  13. This license does not permit commercial manufacturing nor commercial production of the garments in any shape, manner or form. Under the terms and conditions of this license, commercial would refer to a large-scale operation; an amount that is beyond the capacity of one person to produce by hand.
  14. Garments made from the pattern/s can only be sold through public storefronts such as a bricks and mortar store, market stands, online stores, blogs, facebook pages or online mall stores.
  15. Garment descriptions must include the following statement; “This garment is hand knit with permission under a Cottage License from Sheila Toy Stromberg Designs.”
  16. The licensee is responsible for abiding by any current and future federal, state and local laws and regulations pertaining to their own home business as well as any and all laws and regulations that pertain to any manufacturing of goods they perform in their home and the sale of such goods.
  17. I makes no guarantee or promise with regard to income derived from the use of the pattern/s and or purchase of this License.
  18. I reserves the right to decline the sale of a license to any person, for any reason. I also do not accept returns of the license for a return of money. If license is revoked due to licensee’s breach of contract, no refund will be given.
  19. I assumes no liability for any loss or injury on the part of the licensee, their business or customers.
  20. In agreeing to these terms and conditions the licensee indemnifies Sheila Toy Stromberg from any liability whatsoever.
